APPENDIX 3X – INITIAL DIRECTOR’S INTEREST NOTICE

Pursuant to Listing Rule 3.19A, Soil Sub Technologies Limited (“the Company”) lodged an Appendix 3X, Initial Director’s Interest Notice, pertaining to Mr Brian Delaney’s interest upon being appointed as a Director. This notice was lodged on Tuesday, 10[th] February 2009, and consequently, was not lodged within five business days as required by the Listing Rules. Accordingly, the Company confirms the following:

1. The Appendix 3X was not lodged within five business days after the appointment of Mr Brian Delaney as a Director due to an administrative oversight.

Specifically, the Company had nominated two people for communications under Listing Rule 12.6, and there was a confusion of duties between the parties. The named Director provided the Company with disclosure of his interests at the time of appointment as per the procedure the Company has in place.

1. The Company has a procedure in place to ensure compliance with Listing Rules 3.19A, 3.19B, and Guidance Note 22, and as such is aware of their obligations in relation to the ASX Listing Rules.

2. In consideration of the Listing Rules, the Company has an agreement in place with its Directors, and will now remind the Directors of their obligations at regular intervals. In addition to this, the Company now only has one person responsible for communications for the purposes of Listing Rule 12.6.
