Update on ATLA legal proceedings
Leigh Creek Energy Limited (ASX: LCK) (“LCK” or “the Company”) announced on 7 September 2018 that an application had been made on behalf of the Adnyamathanha Traditional Lands Association (“ATLA”) by the NSW Environmental Defenders Office (“EDO”) seeking judicial review of the decision by the Department for Energy and Mining (DEM) to allow the Company to operate under an existing Statement of Environmental Objectives (SEO). The application also seeks an injunction to delay operational start-up of the PCD.
The South Australian Supreme Court has today agreed to hear the application for an injunction ahead of the application for judicial review. The Court today ordered that the interlocutory application for injunction be heard on Tuesday the 18[th] of September 2018. No schedule has been set regarding the judicial review.
The Company is confident that it has obtained all requisite approvals under the relevant legislation to conduct its PCD and that its approvals are valid. The South Australian Department for Energy and Mining (formerly Department of Premier and Cabinet) and other South Australian government departments have applied forensic scrutiny to LCK’s proposed works, including the PCD ahead of each approval granted to the Company.
The Company has complied, and will continue to comply, with the requirements of South Australian government regulatory authorities in relation to the Leigh Creek Energy Project. While the Company respects the concerns of members of the community, it does not understand there to be any factual or legal basis to sustain the claims made against it.
The Company is well prepared to put its case forward to defeat the claims made against it and will inform the market of all material developments.
