Enclosed please find MT Højgaard announcement of 3 August 2017 regarding that MT Højgaard is found responsible in offshore case. The Supreme Court in London has today issued its final ruling that MT Højgaard is liable for the costs of repairing the grouted connections at the Robin Rigg offshore windfarm. As a result of a provision made previously, the ruling will not affect the MT Højgaard groups's financial forecasts of revenue and EBIT before special items for 2017, but special items will be affected by the costs of the legal proceedings.

For 2017, in addition to our share of 54% in the MT Højgaard group's profit after tax and minority interests, the Højgaard Holding group still expects a small positive result before tax.

MT Højgaard found responsible in offshore case

The Supreme Court in London has today issued its final ruling that MT Højgaard is liable for the costs of repairing the grouted connections at the Robin Rigg offshore windfarm. As a result of a provision made previously, the ruling will not affect the MTH GROUP's financial forecasts of revenue and EBIT before special items for 2017, but special items will be affected by the costs of the legal proceedings.

The Supreme Court in London has today ruled that MT Højgaard is liable for the costs of repairing the foundations for the Robin Rigg wind farm off the west coast of Scotland. The ruling is final.

In 2007-2009, MT Højgaard designed, manufactured and installed foundations for the Robin Rigg offshore wind farm off the west coast of Scotland. After commissioning of the wind farm, weaknesses were discovered in the grouted connections as a result of errors in the then applicable international standard issued by DNV.

The wind farm owner, E.ON Climate and Renewables, claimed that MT Højgaard was responsible for the problems and therefore liable for damages, in particular for the repair of the weaknesses. MT Højgaard denied liability, arguing that the applicable standard had been observed as required by the client. With its ruling today, the Supreme Court has found MT Højgaard liable.

The ruling will not affect the MTH GROUP's financial forecasts of revenue and EBIT before special items for 2017, but special items will be affected by the costs of the legal proceedings.
