ASX ANNOUNCEMENT (ASX: FAU)

708A CLEANSING NOTICE

First AU Limited (“ the Company ”) gives notice under section 708A(5)(e) of the Corporations Act 2001 (Cth) (“ Act ”) in compliance with the requirements of section 708A(6) of the Act as follows:

• (a) On 3 December 2021, the Company issued:

  • (i) 76,828,593 quoted options (FAUOA) as free-attaching to placement shares issued on 19 October 2021 on the basis of one option for every two shares issued; and

  • (ii) 35,000,000 quoted options (FAUOA) as part consideration for lead manager services provided to the Company in the recent placement.

• (b) The quoted options (FAUOA) were issued without disclosure under Part 6D.2 of the Act.

• (c) As at the date of this notice, the Company has complied with:

  • (i) the provisions of Chapter 2M of the Act as they apply to the Company; and

  • (ii) the provisions of section 674 of the Act.

• (d) As at the date of this notice, there is no information that is ‘excluded information’ (within the meaning of section 708A(7) and 708A(8) of the Corporations Act).

Appendix 2As with respect to the issues were released to ASX at or about the time of this notice.
