CLEANSING NOTICE UNDER SECTION 708A(5)(E) OF THE CORPORATIONS ACT

BPH Energy Limited (“BPH”) gives the following notice under section 708A(5)(e) of the Corporations Act 2001 (” Act”) that:

1. On 20th January 2026 BPH issued a total of 134,222,222 fully paid ordinary shares (the “Securities”) as part of the placement announced by BPH on 12 January 2026.

2. BPH issued the Securities without disclosure to investors in accordance with Part 6D.2 of the Act.

3. As at the date of this notice, BPH has complied with:

• the provisions of Chapter 2M of the Act as they apply to the Company; and

• section 674 and section 674A of the Act.

1. As at the date of this notice, there is no information which is “excluded information” within the meaning of section 708A(7) of the Act which is required to be disclosed by the Company in accordance with section 708A(8) of the Act.
