Notice under section 708A(5)(e) of the Corporations Act 2001 (Cth)

3 July 2024 ‐ Weebit Nano Ltd (ACN 146 455 576) (ASX: WBT) (“ Weebit ” or “ Company ”) is hereby giving notice under section 708A(5)(e) of the Corporations Act 2001 (Cth) (“ Corporations Act” ).

Weebit issued 130,400 fully paid ordinary shares (“ Shares ”) on 27 June 2024 following the vesting and exercise of 130,400 performance rights pursuant to the Company’s Employee Incentive Option Plan. An Appendix 2A with respect to the issue of the Shares was lodged by the Company today.

Weebit confirms that:

• a) the Shares were issued without disclosure under Part 6D.2 of the Corporations Act;

• b) as at the date of this notice, Weebit has complied with:

• i. the provisions of Chapter 2M of the Corporations Act as they apply to Weebit; and

• ii. sections 674 and 674A of the Corporations Act; and

• c) as at the date of this notice, there is no excluded information of the type referred to in sections 708A(7) and 708A(8) of the Corporations Act that is required to be set out in this notice under section 708A(6)(e) of the Corporations Act.
