NOTICE UNDER ASIC CLASS ORDER 09/425

This notice is given by Peet Limited (ABN 56 008 665 834) (Peet) under Australian Securities & Investments Commission (ASIC) Class Order 09/425.

The Company has announced an offer of fully paid ordinary shares (Shares) under a share purchase plan (SPP) to shareholders who are registered holders of Shares as at 7.00pm (Sydney time) on 31 May 2011 and whose address as recorded in Peet's register of members is in Australia or New Zealand, to be made in accordance with the requirements of ASIC Class Order 09/425.

Peet advises that:

• (a) the new Shares will be issued under the SPP without disclosure to investors under Part 6D.2 of the Corporations Act 2001 (Cth) (the Act);

• (b) this notice is being given under ASIC Class Order 09/425;

• (c) as at the date of this notice, Peet has complied with:

  • (i) the provisions of Chapter 2M of the Act as they apply to Peet; and

  • (ii) section 674 of the Act as it applies to Peet; and

• (d) as at the date of this notice, there is no excluded information of the type referred to in sections 708A(7) and 708A(8) of the Act.
