(b) The plaintiff submits that Shri. Shyam Babulal Gupta hereinafter for short referred to as “The Missing Person” who is missing since 28/08/2010- that the missing person has left his house on Chembur(W). Mumbai & has not returned thereafter. The plaintiff further submits that accordingly the plaintiff is being the wife of Shri. Shyam Babulal Gupta has lodged a complaint with that effect with Chembur police station on -15/09/2010 which is registered by the concern police station & accordingly the certificate with that effect is issued by the concern police station on 09/02/2011. The plaintiffs further submits that the plaintiff thereafter in the month of August enquired with the Chembur Police Station regarding missing person & accordingly Certificate dated 15/09/2010 has been issued by the Concerned Police Station. (Here the annexed & mark Exh-A, B &Cc (c) The plaintiffs Further submits that Shri. Shyam Babulal Gupta missing till the Date and passion about the missing person is same under such circumstances the plaintiff has left with no other better option than to approach to honorable court as per law to seek deceleration about the missing person presume to be dead as nobody has been seen him or heard of him since the date i.e. 28/08/2010. The plaintiff states that the same position about “The Missing Person” continuous till date. (d) The plaintiff is advised to states that under the circumstance, wherein the law stipulates that “The Missing Person” is presumed to be dead as nobody has been seen him or heard of him since the date Viz. 28/08/2010 (8 years) by those who would naturally have seen/ heard of him if he had been alive and therefore he has been presume to be dead. The plaintiff further submits that it had no more than 81 years there is still no trace of “The Missing Person” and therefore there is no reason, not to accept that he has died. (e) The plaintiff states that under this circumstances plaintiff visited office of Defendant no.2 with a view to obtain a death certificate ot the deceased whereupon they were advised by the concern ward officer that as per the guidelines No.5,6 for the registration of birth and death Certificate issued by the home department it is necessary to obtain decree of declaration etc. from the court having competent jurisdiction in respect of date, place etc. of the deceased and till then such certificate cannot be issued only on the basis of documents including which are submitted to defendant no. 1 and referred to herein above. (f) The plaintiffs as a matter of abundant precautions and to avoid even a lame excuse and /or technical defence being taken up served upon the defendants statutory notice u/s 487 of BPMC Act to the defendant No. 2 enclosing therewith the above referred certificates. The said notice was issued by R.P.A.D to the concern authority on dated and it was received by them also. The plaintiff also served the notice to defendant No.1 also on however it was returned to the sender. The plaintiffs submit that obviously there is no question of the defendants had made their stand clear and it is only because of that and at their instances the present suit is being filed for the reliefs prayed for herein .The plaintiffs have filed office copy of the said notice which is filed separately .The plaintiffs in the circumstance are constrained to file the present suit. (g) The plaintiffs submit that the cause of action firstly accrued when the Chembur police station issued certificate on -09/02/2011 in respect of missing person from Chembur area. The after when the plaintiff approach again to Chembur Police Station on dated 5/4/2011 and till it is continuous. Therefore the Plaintiff has to approach before this Hon’ble court by way of this present suit. (h) It be ordered and declared that Shri Shyam Babulal Gupta has died on 09/02/2011 at Chembur (w), Mumbai 400071 within the jurisdiction of defendants & petition filed by his legal heirs. (i) The defendants may be ordered and directed to issue death certificate in terms of prayer clause (a) above. (j) Cost of the suit is provided for. (k) Such other and further reliefs as may be necessary and /or expedient and/or which this Hon’ble court deems fit and proper in the facts, nature and circumstances of the case may kindly be granted in favour of the plaintiff.
