Divan Talya Otelimizin yeniden yapımı ve Konferans Merkezi'nin yenilenmesi projesi ile ilgili olarak ilk defa 21.08.2023 tarihli özel durum açıklamamızda ve son olarak 22.05.2024 tarihli faaliyet raporumuzda yer verilen; 1/5000 Ölçekli Nazım İmar Planı, 1/1000 Ölçekli Uygulama İmar Planı ile otel inşaatı için verilen inşaat ruhsatının iptali talebi ile Antalya Büyükşehir Belediye Başkanlığı ile Muratpaşa Belediye Başkanlığı aleyhinde açılan ve Şirketmizce müdahil olunan davada; Antalya İdare Mahkemesi tarafından kısmen kabul kısmen red kararı verilerek; 1/5000 ölçekli Nazım İmar Planının iptali talebinin reddine; 1/1000 ölçekli Uygulama İmar Planı ile bu plana bağlı inşaat ruhsatının iptal talebinin ise kabulüne oyçokluğu ile karar verildiği bilgisi edinilmiş olup, karar henüz Şirketimize tebliğ edilmemiştir .

İlk derece mahkemesi tarafından verilen söz konusu karar kesin nitelikte olmayıp karara karşı bir üst derece mahkemesinde istinaf yolu açıktır. Şirketimiz tarafından sürdürülmekte olan inşaat faaliyetleri, söz konusu hukuki sürecin ilerleyen aşamalarındaki gelişmelere göre netleşecektir.

Konuya ilişkin gelişmeler konunun önemine göre özel durum açıklaması ve/veya faaliyet raporlarımız aracılığıyla yatırımcılarımız ile paylaşılacaktır.

Regarding the reconstruction project of Divan Talya Hotel and the renewal of the Conference Center, it was first included in our special event statement dated 21.08.2023 and lastly in our activity report dated 22.05.2024; in the case filed against Antalya Metropolitan Municipality and Muratpaşa Municipality, requesting the cancellation of the 1/5000 Scale Master Zoning Plan, 1/1000 Scael Implemantation Plan and the construction license given for the hotel construction, and in which our Company was involved; it has been learned that Antalya Administrative Court gave a partially acceptance and partially rejection decision; rejection of the request for cancellation of the 1/5000 scale Master Development Plan; acceptance of the request for cancellation of the 1/1000 scale Implementation Zoning Plan and the construction license attached to this plan. Decision was taken by majority vote and the court order has not been notified to our company yet.

The decision given by the First Instance court is not final and an appeal against the decision is open to a higher court. The construction activities carried out by our company will be clarified according to the developments in the later stages of the legal process in question.

Developments regarding the issue will be shared with our investors through special event disclosure and/or activity reports, depending on the importance of the issue.
