(c) On October 17, 2013, The Kroger Co. (the “Company”) announced that Michael L. Ellis, 55, will be named President and Chief Operating Officer, effective January 1, 2014. Mr. Ellis is a current executive officer of the Company, and the information relating to him required by Item 5.02(c) of Form 8-K has been previously reported in the Company’s annual report on Form 10-K for the fiscal year ended February 2, 2013 filed with the Commission on April 2, 2013.
