Application for Certification of Class Action
The Company hereby reports, that yesterday a certain Israeli environmental association filed an application for certification of a class action to the district court in Jerusalem, against 30 defendants, including Fertilizers and Chemicals Ltd., a subsidiary of the Company, relating to air pollution in the Haifa Bay (located at the northern part of Israel), and the alleged illness therefrom to the area's population.
The applicant requests for a declaratory relief and for the establishment of a mechanism for the award of compensation but does not specify the amount of the compensation claimed. Alternatively, the applicant requests for a division of the remedies that will enable each member of the group to sue for damages in a separate proceeding.
As of the date of this report, the application has yet to be served to the Company. Following its receipt, the Company will respond to the claims within the framework of the legal proceeding.

בקשה להכיר בתביעה כייצוגית
החברה מבקשת להודיע, כי עמותה ישראלית שעוסקת בסביבה הגישה אתמול תביעה ובקשה להכיר בתביעה כייצוגית כנגד 30 נתבעים ובהם דשנים וחומרים כימיים בע"מ, חברה בת של החברה, לבית המשפט המחוזי בירושלים, בגין טענות המתייחסות לזיהום אוויר במפרץ חיפה ולתחלואה הנגרמת ממנו, על-פי הנטען, לאוכלוסיית אזור חיפה.
בבקשה עותרת המבקשת לסעד הצהרתי ולהקמת מנגנון לפסיקת פיצויים אך אינה נוקבת בסכומי הפיצוי הנתבעים, ולחילופין, לפיצול סעדים, שיאפשר לכל אחד מחברי הקבוצה לתבוע את נזקיו בהליך נפרד. נכון למועד דיווח זה, מסמכי הבקשה טרם הומצאו לחברה. לאחר המצאתם, החברה תגיב לטענות
במסגרת ההליך המשפטי.
