Whereas the Plaintiff abovenamed have instituted a Suit relating to a commercial dispute against you, as set out in the plaint herein, whereof the following is a concise statement, VIZ:-
- THE PLAINTIFF THEREFORE PRAYED:
a) That this Hon’ble be pleased to declare
i. As on July 31, 2018, there is due and payable to the Plaintiff the sum of USD 7,769,837.47 (Rs 551,347,666.85 @ 70.96 per USD, as on August 31, 2018) as per Particulars of the Plaintiff's Claim annexed and marked EXHIBIT “T” hereto. The amount includes the principal amount of USD 7,391,304.35, interest of USD 378,533.12 calculated at the default rate, together with further interest as per the default interest of 6.009280% from September 1, 2018 till the date of payment and / or realization, costs and expenses of the present proceeding already incurred and provision for those likely to be incurred.: ii. Defendant No. 3 has failed and/or neglected and/or refused and still refuses to pay the Plaintiff, the said sum or any part thereof. The said amount continues to remain outstanding, due and payable: iii. The repayment of the said amount is duly secured by a valid and subsisting First Preferred Mortgage of Defendant Nos. 1 and 2 in favour of the Plaintiff; and iv. The Plaintiff is entitled enforce and/or crystallize the said security of First Preferred Mortgage of the Defendant vessels in favour of the Plaintiff
b) That this Hon’ble pleased to
i. Pass an Order and decree against the Defendant Nos. 1 and 2 and in favor of the Plaintiffs for USD 7,169,837.47 ( Rs 551,347,666.85 @ 70.96 per USD, as on August 31, 2018) as on August 31 2018, which includes the principal amount of USD 7,391,304.35, interest of USD 378,533.12 calculated at the default rate, together with further interest as per the default interest of 6.009280% from September 1, 2018 till the date of payment and / or realization, costs and expenses of the present proceeding already incurred and provision for those likely to be incurred.: ii. Pass an Order and decree against Defendant No. 3 and in favor of the Plaintiffs for the amounts that remain outstanding after adjusting the amounts realized from the sale proceeds of Defendant Nos. 1 and 2 and credited to this Suit against the amounts set in theParticulars of Claim.

And you are hereby summoned to file a written statement within 30 days of the service of the present summons and in case you fail to file the written statement within the said period of 30 days, you shall be allowed to file the written statement on such other day, as may be specified by the Court, for reasons to be recorded in writing and on payment on such costs as the court deems fit, but which shall not be later than 120 days from the date of service of summons. On expiry of one hundred and twenty days from the date of service of summons, you shall forfeit the right to file the written statement and the court shall not allow the written Statement to be taken on record. You are required to appear in the court in person, or by a pleader relating to suit, duly instructed and able to answer all material questions relating to suit, or shall be accompanied by some person able to answer all material type questions before the Judge in Chambers to answer the Plaintiff's claim on 27th Nov., 2020 at 11 O’clock in the forenoon, to answer the claim : and further you are hereby to produce on the said day all documents in your possession or power upon which you base your defense or claim for set-off or counter-claim and where you rely on any other document whether in your possession or power or not, as evidence in Support or your defense or claim for set-off or counter claim, you shall enter such documents in list to be annexed to the written statement.
