Eisenach/Karlsruhe, 02 February 2007 – Legislators set binding regulation
for obligatory information for business e-mails

The regulation for electronic commercial and cooperative registers as well
as the companies registry 'Gesetz über elektronische Handelsregister und
Genossenschaftsregister sowie das Unternehmensregister' (EHUG), took effect
as of 01 January 2007. This regulation sets new form requirements for
business e-mail communication with regard to obligatory information to be
included in the correspondence.

That, which has been valid for the past years in printed materials, now
finds application in electronic communication. Since the beginning of the
year, information usually found in the footer of the first page of a
business letter must also be included in business e-mails. Legislators
defined the minimum information required in paragraphs 125a HGB (German
commercial code), 80 AktG (stock corporation law) und 35a GmbHG (LLC/Ltd
code). These include, for example, the legal form and company headquarters,
the register court and the number under which the company is registered in
the commercial registry.

These changes therefore affect all companies and their external e-mail
communication – such as proposals, purchase orders, shipment confirmation,
delivery confirmation, invoices, etc. Should the required information not
be included fines may be imposed.

can be adapted to the legal positions of other states to comply with the
requirements set by the EU.
