its voting rights on Fresenius Medical Care AG & Co. KGaA, Bad Homburg,
Germany, ISIN: DE0005785802, WKN: 578580 have crossed the 5% threshold of
the voting rights on February 6, 2013 and on that day amounted to 5.003%
(this corresponds to 15,147,822 voting rights). According to Article 22,
Section 1, Sentence 1, No. 6 WpHG, 5.003% of the voting rights (this
corresponds to 15,147,822 voting rights) is to be attributed to the
company.

according to Article 21, Section 1 of the WpHG that via shares his voting
