Paris, March 19th, 2013
In the dispute opposing, in the presence of ERAMET, Carlo Tassara France and SIMA, Sorame, Ceir and various members of the Duval family, the Paris Court of Appeal ruled as follows on March 19th , 2013:
"confirms the judgment [of the Tribunal of Commerce] in all its provisions,
Adding:
Condemns Carlo Tassara France to pay, pursuant to article 700 of the Code of Civil Procedure, to the jointly interested Duval parties and Sorame and Ceir together the sum of 50,000 euros, to ERAMET 50,000 euros and to EHA, under Sima's rights, 30,000 euros;
Rejects all other claims,
Orders Carlo Tassara France to pay any appeal expenses that may be recovered under the provisions of article 699 of the Code of Civil Procedure."
The Paris Tribunal of Commerce, in its judgment dated December 2nd, 2011, had ruled as follows:
"- Declares SAS CARLO TASSARA FRANCE inadmissible:
pursuant to prescription,
with respect to its claims concerning the contribution of SAS SOCIETE INDUSTRIELLE DE METALLURGIE AVANCEE S.I.M.A to SA ERAMET and continuations thereof,
with respect to its claims concerning the support provided by SA ERAMET to SAS SOCIETE INDUSTRIELLE DE METALLURGIE AVANCEE S.I.M.A and the company SMC,
Dismisses all other claims by SAS CARLO TASSARA FRANCE,
Dismisses the claim by SCPA SORAME, SAS CEIR and jointly interested DUVAL parties for damages for abuse of process,
Orders SAS CARLO TASSARA FRANCE to pay, with respect to article 700 of the code of civil procedure (CPC):
to SA ERAMET the sum of €300,000,
to SCPA SORAME, SAS CEIR and jointly interested DUVAL parties (private individuals) together the sum of €300,000,
to SAS SOCIETE INDUSTRIELLE DE METALLURGIE AVANCEE S.I.M.A. the sum of €150,000,
Dismisses all other, broader or opposing claims by the parties,
Orders the provisional execution of the present judgment;
Orders SAS CARLO TASSARA FRANCE to pay full costs."
