In reference to Current Report No. 48/2022 of 7 July 2022, theManagement Board of ENEA S.A. ("Company", "Issuer") hereby reports thaton 26 July 2022 it signed an annex to the surety agreement with IzbaRozliczeniowa Giełd Towarowych S.A. ("IRGiT") for the liabilities of itssubsidiary, ENEA Elektrownia Połaniec S.A. ("Agreement"). The annexincreases the surety amount by PLN 6,800,000,000, that is to PLN10,800,000,000. The increase in the surety amount aims to optimize theportfolio of collateral contributed to IRGiT.

In connection with the execution of the annex, the Issuer will provide anotarized declaration of its voluntary submission to enforcementpursuant to Article 777(1)(5) of the Code of Civil Procedure up to theamount of the granted surety, that is up to PLN 10,800,000,000. IRGiTwill be entitled to initiate legal action to issue an enforcement clauseon the said notarized declaration until 30 September 2023.

All other terms of the Agreement remain unchanged.
