COCHLEAR TO VIGOROUSLY DEFEND PATENT INFRINGEMENT COMPLAINT
Sydney: 21 December 2007, Cochlear Limited (COH.AX) today advised that a complaint for patent infringement has been filed by the Alfred E. Mann Foundation for Scientific Research (The “Foundation”) in the US District Court, Central District of California (Los Angeles).
The complaint names Cochlear Limited and its USA subsidiary Cochlear Corporation (now known as Cochlear Americas) as defendants. Whilst the complaint has been filed it has not been served upon either company.
The Foundation alleges that one of six identified patents has been infringed, specifically United States Patent No 5,609,616 entitled Physician’s Testing System and Method for Testing Implantable Cochlear Stimulator, issued 11 March 1995.
The complaint states that the six patents are licensed to Advanced Bionics. Advanced Bionics is a competitor of Cochlear.
Cochlear believes that the Foundation’s allegations of infringement are without merit and intends to vigorously defend against the complaint.
