CIR: SENTENZA TRIBUNALE DI MILANO SU DANNI NON PATRIMONIALI LODO MONDADORI

Milano, 10 luglio 2015 - CIR-Compagnie Industriali Riunite S.p.A. rende noto che è stata depositata oggi la sentenza del Tribunale di Milano nel nuovo giudizio promosso dalla società contro Fininvest per il risarcimento del danno non patrimoniale causato dalla corruzione in atti giudiziari nella vicenda Lodo Mondadori. Il giudizio fa seguito a quello sui danni patrimoniali concluso circa due anni fa con la sentenza della Corte di Cassazione favorevole a CIR.

Nella sentenza odierna il giudice, pur avendo accolto la domanda di CIR e riconosciuto l'esistenza del danno non patrimoniale determinato dalla lesione del suo diritto a un giudizio imparziale, ha liquidato detto danno per un importo pari a € 246.000 che CIR e i propri legali giudicano largamente inadeguato rispetto al gravissimo illecito subito e all'entità delle conseguenze pregiudizievoli che ne sono derivate a carico della vittima. Il giudice ha inoltre respinto la domanda riconvenzionale proposta da Fininvest contro CIR. La società si riserva di ricorrere in Appello.

CIR: COURT OF MILAN RULES ON LODO MONDADORI NON-PATRIMONIAL DAMAGES

Milan, July 10 2015 - CIR-Compagnie Industriali Riunite S.p.A. announces that the ruling of the Court of Milan has been filed in the new case brought by the company against Fininvest for compensation for the non-patrimonial damage caused by judicial corruption in the Lodo Mondadori affair. The ruling follows the one regarding patrimonial damages, which ended about two years ago with the pronouncement of the Court of Cassation in CIR's favour.

With today's ruling, while upholding CIR's claim and acknowledging the existence of non-patrimonial damages caused by the infringement of the latter's right to an impartial ruling, the judge liquidated the said damages to the amount of € 246,000, which is deemed by CIR and its legal counsel to be grossly inadequate given the extremely serious nature of the offence committed and the extent of the negative consequences suffered by the victim. The judge also rejected the counterclaim brought by Fininvest against CIR. The company reserves the right to appeal against the ruling.
