Item 2.02 Results of Operations and Financial Condition.

On January 28, 2010, China BAK Battery, Inc. (the “Company”) issued a press release announcing its financial results for the fiscal quarter ended December 31, 2009. A copy of the press release is furnished as Exhibit 99.1 hereto.
