COMPANY ANNOUNCEMENT 10 OCTOBER 2012

NOTICE UNDER SECTION 708A(5)(E) OF THE CORPORATIONS ACT

Austal Limited ABN 73 009 250 266 (Company) has issued 2,481,566 ordinary shares in the Company to Gregory McKechnie as trustee for the McKechnie Family Trust ABN 70 874 462 230 and Kenny Nominees (NT) Pty Ltd ACN 160 006 511 as trustee for The Kenny Family Trust #2 ABN 54 917 421 776 as announced on 4 October 2012.

The Company gives notice under section 708A(5)(e) of the Corporations Act 2001 (Cth) (Act) that:

  1. the Company issued 2,481,566 ordinary shares in the Company without disclosure to investors under Part 6D.2 of the Act;

  2. as at the date of this notice, the Company has complied with the provisions of Chapter 2M and section 674 of the Act as they apply to the Company; and

  3. as at the date of this notice, there is no information that is ‘excluded information’ within the meaning of section 708A(7) of the Act.
