Receipt of the Report Concerning the Process of Obtaining an Exploitation Concession

The Board of Directors of Coal Energy S.A. (the "Company") hereby informs that its subsidiary, Advanced Industrial Technologies Sp. z o.o., has received a report prepared by the law firm Kancelaria Juris sp. z o.o. under the agreement concluded in September of this year. The Company had previously informed about the conclusion of this agreement in Current Report No. 22/2025 dated 25 September 2025.

The legal and technical report confirms the possibility of obtaining an exploitation concession for the "Bobrek–Miechowice" hard coal deposit located on the border of Zabrze and Bytom, and constitutes one of the elements of the process of applying for a mining license.

At the current stage, the following work has been completed:

  • a) geological information related to the 400-metre level of the Bobrek-Miechowice, Bobrek-Miechowice-1 and Bobrek-Miechowice-2 deposits has been obtained, and a preliminary rock-mass analysis has been carried out;
  • b) the legal status of the surface infrastructure has been examined;
  • c) a preliminary assessment has been conducted of the environmental, natural, water, gas, heritageprotection and municipal-infrastructure conditions;
  • d) the development policies and positions of the local authorities of three municipalities the City of Bytom, the City of Ruda Śląska and the City of Zabrze — have been analysed;
  • e) a risk analysis has been carried out and recommendations have been issued regarding the further steps in the process of obtaining the exploitation concession.

After obtaining the above information, the Company, in cooperation with its advisor, will take further actions related to the licensing process, taking into account the recommendations concerning the preparation of the investment project.

The Board of Directors has decided to publish the above information as inside information due to its significant importance for the implementation of the stages of the strategy disclosed in Current Report No. 21/2025.
