A German court (Landgericht) has issued a ruling preventing German manufacturer ITM Einkaufs GmbH from selling a model similar in design to Doro's phones. The court found that the phone represented an encroachment on one of Doro's registered designs for its PhoneEasy® 410gsm model.
During the autumn, the German company launched a new mobile phone that in crucial respects resembled Doro's best-selling model, the Doro PhoneEasy® 410gsm. Having been made aware of the similarities, Doro brought suit against ITM in the German court, requesting that it immediately ban further marketing and sales of the product.
The court responded swiftly, prohibiting ITM from selling and marketing its copied product pending a final ruling in the case. ITM requested a reassessment of this ruling and was given the opportunity to make a statement regarding the suit brought by Doro and the ruling of the court. On December 17, 2010, the court resolved to maintain its ruling, which is a provisional injunction, prohibiting ITM from selling its product.
