Enerjia Metal Maden Sanayi ve Ticaret A.Ş. unvanlı bir şirketin başvurusu üzerine Ankara 31. İcra Müdürlüğü tarafından Şirketimiz'e 68.411.344,82 USD meblağlı iflas yoluyla adi ödeme emri tebliğ edilmiş olduğu 29.03.2010 tarihinde; Şirketimiz'ce bu takibe yasal süresi içerisinde ve usulüne uygun bir şekilde itiraz edildiği, 02.04.2010 tarihinde; adı geçen şirketin, başlatmış olduğu takibin devamını teminen, Ankara 7. Asliye Ticaret Mahkemesi'nde Şirketimiz'e karşı 68.312.520,00 USD meblağlı bir iflas davası açmış olduğu (2010/259 E.), 22.04.2010 tarihinde; Mahkemenin, kısa kararını açıklayarak davayı reddettiği, 23.06.2011 tarihinde, gerekçeli kararın ve Enerjia Metal Maden Sanayi ve Ticaret A.Ş.'nin temyiz dilekçesinin 25.08.2011 tarihinde Şirketimiz'e tebliğ edilmiş olduğu da 26.08.2011 tarihinde kamuya duyurulmuştur. Bahsi geçen temyiz talebi üzerine Yargıtay 23. Hukuk Dairesi'nin 06.04.2012 tarih ve E. 2011/2915; K. 2012/2675 sayılı bozma kararının, Şirketimiz'in davayı takip eden avukatlarına, 18.05.2012 günü tebliğ edildiği hususu da 21.05.2012 tarihinde kamuya duyurulmuştur. Yargıtay'ın bozma kararından sonra dosya Ankara 7. Asliye Ticaret Mahkemesi'ne gönderilerek, 2013/17 Esas numarası almıştır.

Ticaret mahkemeleri ile ilgili yapılan yasal düzenleme çerçevesinde davanın heyetçe görülmesi gereken davalardan olması nedeniyle dosya Ankara 4. Asliye Ticaret Mahkemesi'ne gönderilmiştir. Mahkeme, 09 Eylül 2015 tarihli duruşmada davayı reddetmiştir (2014/734 E.). Yerel mahkeme kararı, Yargıtay 23. Hukuk Dairesi'nin 07.05.2018 tarih, E. 2017/2657 ve K. 2018/2943 sayılı kararı ile onanmıştır. Onama kararı 26.06.2018 tarihinde Şirketimize tebliğ edilmiştir. Davacı Enerjia, karar düzeltme talebinde bulunmuştur. Davacı Enerjia Metal Maden Sanayi ve Ticaret A.Ş.'nin karar düzeltme talebinin, Yargıtay 23. Hukuk Dairesi'nin 01.07.2019 tarih, E. 2018/2167 ve K. 2019/3083 sayılı kararı ile reddedildiği bugün öğrenilmiştir.

It is publicized on 26.08.2011 that upon an application of a company with titled as Enerjia Metal Maden San. ve Tic. A.Ş., a simple order with the form of bankruptcy with the value of 68.411.344,82  USD by the Ankara Enforcement Office 31st has been notified to our company on 29.03.2010; an objection has been duly and timely made by our company against this proceeding on 02.04.2010; the mentioned company has filed an action of bankruptcy with the value of 68.312.520,00 USD (2010/259 E.) against our company to the Ankara Commercial Court of First Instance 7th on 22.04.2010; the court has stated its short decision and rejected the action on 23.06.2011; the justified decision and the petition of appeal of Enerjia  Metal  Maden  Sanayi  ve  Ticaret A.Ş. have been notified to our company on 25.08.2011. It has been publicized on 21.05.2012 that upon the mentioned petition of appeal, the decision of reversal of judgment of Supreme Court's Chamber 23rd dated 06.04.2012 and E. 2011/2915; K. 2012/2675 has been notified to our attorneys who have been following the case on 18.05.2012. Following the decision of reversal of the judgment taken by the Supreme Court, the file has been sent to Ankara Commercial Court of First Instance 7th and has been given the number 2013/17 Decree.

The file has been sent to the Ankara Commercial Court of First Instance 4th on the grounds that the action is one of those which must be conducted by a board within the legal regulations carried out in relation with Commercial Courts. The Court has dismissed the case at the hearing held on September 09, 2015 (2014/734 E.). Decision of the local court has been approved by the Supreme Court 23th Civil Chamber with the decision dated 07.05.2018 and 2017/2657 Docket; 2018/2943 decision number. The decision of approval has been notified to our Company on 26.06.2018. Enerjia has applied for revision of the decision. It has been informed today that Enerjia Metal Maden Sanayi ve Ticaret A.Ş.'s apply for revision of the decision has dismissed by the Supreme Court 23th Civil Chamber with the decision dated 01.07.2019 and 2018/2167 Docket; 2019/3098 Decision number.

In contradiction between the Turkish and English versions of this public disclosure, the Turkish version shall prevail.
