Re: An Appeal to the Supreme Court on Judgment of the District Court in Tel Aviv which rejected motion to certify a claim as a class action against The Phoenix Pension and Provident Fund Ltd. The Company is hereby announcing that on January 19, 2023, the plaintiffs filed an appeal to the Supreme Court on the Judgment of the District Court in Tel Aviv dated November 22, 2022, which rejected their motion to certify a claim as a class action (hereinafter: "The Judgment"), which was filed against a subsidiary of the Company, The Phoenix Pension and Provident Fund Ltd. (hereinafter: "The Phoenix Pension and Provident") as well as against 4 management companies of additional pension funds (hereinafter, collectively: "The Defendants"), and which concerns with the claim that the Defendants pay agents fees and commissions calculated as a percentage of the management fees charged by them, thus allegedly violating their fiduciary duties, and as a result, the management fees that plan holders are charged are higher than the appropriate rate (See detailed in the Immediate Report dated November 23, 2022 (Reference No. 2022-01-112368), and in Note 7b(11) to the Company's financial statements for September 30, 2022, which were published on November 30, 2022 (Reference No. 2022-01-115344).The Phoenix Pension and Provident is studying the Statement of Appeal. false
