Re: A Claim and a Motion to Certify the Claim as a Class Action against The Phoenix Insurance Company Ltd. (subsidiary) - Immediate Report Notice is hereby given that a Claim has been filed at the District Court - Tel-Aviv against a subsidiary of the Company, The Phoenix Insurance Company Ltd. ("Phoenix Insurance"), and against Maccabi Health Services (HMO) (Ottoman Association) (the "Defendants"), together with a request for approval as a class action, in the Tel Aviv-Yafo Regional Labor Court ("Claim"). The matter of the Claim is that Defendants mislead members of the Maccabi Health Fund regarding the statute of limitations in a the group long-term care insurance policy for Maccabi Health Fund members. Thus, it is argued that the Defendants publish in every relevant document on their website that "the statute of limitations period of the claim for payment of insurance benefits is three years from the date of the occurrence of the insurance case", while in accordance with the Insurance Contract Law, 5741-1981 ("Insurance Contract Law"), the statute of limitations is five years from the date of the occurrence of an insurance case, starting from 25 November 2020 after Amendment No. 11, 5771-2020 to the Insurance Contract Law. It was argued that the total damage to all members of the group could not be estimated at this stage, but the plaintiff noted that the estimated damage exceeded NIS 3 million. At this stage, Phoenix Insurance is studying the details of the Claim, and therefore the chances of its approval as a class action cannot be assessed, and if it is approved, the chances of its success cannot be assessed. false
