Re: A Claim and a Motion to Certify the Claim as a Class Action Against The Phoenix Insurance Company Ltd.(subsidiary) - Immediate Report Notice is hereby given that a Claim accompanied by a motion to certify the claim as a class action ("Claim") has been filed at the District Court � Tel Aviv-Yafo against a subsidiary of the Company, The Phoenix Insurance Company Ltd. ("Phoenix Insurance"), The Claim concerns that Phoenix Insurance sends advertisements to the plaintiff and members of the group through advertisements sent to their e-mail addresses and/or in any other media, without obtaining the express prior written consent of the recipients and without the members of the group being its customers at all. It is also argued that Phoenix Insurance does not allow its recipients, whether they gave their explicit consent to send advertisements in advance, or not, to remove themselves in the same way that the advertisements were sent, but only by means of a link, contrary to section 30A of the Communications Law (Telecommunications and Broadcasting), 5742-1982.According to the plaintiff, the total damage to all members of the group is estimated at NIS 10 million. At this stage, The Phoenix Insurance is studying the details of the Claim, and therefore the chances of its approval as a class action cannot be assessed, and if it is approved, the chances of its success cannot be assessed. false
