Re: A Claim and a Motion to Certify the Claim as a Class Action Against The Phoenix Insurance Company Ltd. (subsidiary) - Immediate ReportThe Company announce that a claim has been filed against a subsidiary of the Company, The Phoenix Insurance Company Ltd. ("Phoenix Insurance"), and against seven other insurance companies (hereinafter, collectively: the "Defendants") together with a request for approval it as a class action, in the Haifa District Court ("Claim").The Claim concerns that the policyholders who hold a service contracts for repairing windshields and who operated the service contracts, were not inspected and/or calibrated by the windshield installers on behalf of the Defendants as part of the process of replacing the windshield and to the extent that such inspection and/or calibration was performed, they were charged an additional fee for this. In addition, it is alleged that the Defendants failed to inform the policyholders at the time of purchasing the service contract that the coverage would not include inspection and calibration of the safety system during the replacement of the windshield.The plaintiffs noted that the damage they estimated to all members of the group is well over NIS 2.5 million (to all the Defendants), while in relation to some members of the group, it was claimed that the damage estimate is NIS 27 million per year (when they claim that this is a period of seven years) (relative to all the Defendants).The plaintiffs noted that there are two claim motions pending to be certified as class actions (one of them also against Phoenix Insurance) that raise similar legal questions.At this stage, Phoenix Insurance is studying the details of the lawsuit, and therefore it is not possible to assess the chances of its approval as a class action, and if it is approved, it is not possible to assess its chances of success. false
