Subject: The decision to amicably settle all disputes regarding theinvalidity of the agreement for the sale of property rights undercertificates of origin between Energa Obrót SA and one of the sued windfarms amicably

In reference to current report No. 37/2017 of 11 September 2017, theManagement Board of Energa SA informs that on 27 February 2020 itreceived information that its subsidiary Energa Obrót SA and one of thecontractors sued by Energa Obrót SA, amicably resolved all disputesregarding the three framework agreements for the sale of property rightsunder certificates of origin referred to in current report No. 37/2017.

The parties to the settlement decided not to continue cooperation in thescope of acquiring property rights on the basis of agreements questionedby Energa Obrót SA.

The conditions under which the settlement was concluded are neutral forthe financial result of Energa Obrót SA.

This is the seventh settlement between Energa Obrót SA and the sued windfarms. The total capacity of the facilities affected by the settlementsconstitutes about 57.5% of the total installed capacity of alldefendants of wind farms.
