NOTIFICATION

Acting on the basis of article 69 section 1 point 1 in connection with article 69a section 1 point 1 ) of the Act of 29 July 2005 on public offer and conditions of introduction of financial instruments to the organized trading system and on public companies ("Act on Offer"), the Notifier hereby notifies of exceeding the threshold of niniejszym zawiadamia o przekroczeniu 50% of the total number of votes in the company Aqua S.A. with its registered seat in Bielsko-Biała ("Company"), listed on the NewConnect market.

ZAWIADOMIENIE

Działając na podstawie art. 69 ust. 1 pkt 1 w związku z art. 69a ust. 1 pkt 1) ustawy z dnia 29 lipca 2005 r. o ofercie publicznej i warunkach wprowadzania instrumentów finansowych do zorganizowanego systemu obrotu oraz o spółkach publicznych ("Ustawa o Ofercie"), Zawiadamiający progu 50% ogólnej liczby głosów na Walnym Zgromadzeniu Aqua S.A. z siedzibą w Bielsko-Białej ("Spółka"), notowanej na rynku NewConnect.

Prior to the Event, the Notifier held 4,309,402 shares in the Company, representing 33.18% of the Company's share capital. The above shares entitled to 4,309,402 votes, representing 33.18% of the total number of votes

Currently, the Notifier holds 4,309,402 shares of the Company, representing 33.18% of the share capital of the Company. Those shares entitle to 4,309,402 votes, representing 67.81% of the total number of votes, due to the loss of the right to vote from 6,631,553 shares of the Company by the Municipality of Bielsko-Biała.

Subsidiaries of the Notifier do not hold shares in the Company.

The Notifier is not a party to any agreements concerning the transfer of the right to exercise voting rights from the Company's shares within the meaning of Article 87 section 1 point 3 letter c of the Act on Offer.

The Notifier does not hold any financial instruments, which after the expiration of the maturity date unconditionally entitle or oblige their holder to purchase shares, to which voting rights are related, already issued by the Company, mentioned in art. 69b section 1 point 1 of the Act on Offer.

Podmioty zależne od Zawiadamiającego nie posiadają akcji Spółki.

Zawiadamiający nie jest stroną umów dotyczących przekazania uprawnienia do wykonywania prawa głosu z akcji Spółki w rozumieniu art. 87 ust. 1 pkt 3 lit. c Ustawy o Ofercie.

Zawiadamiający nie posiada instrumentów finansowych, które po upływie terminu zapadalności bezwarunkowo uprawniają lub zobowiązują ich posiadacza do nabycia akcji, z którymi związane są prawa głosu, wyemitowanych już przez Spółkę, o których mowa w art. 69b ust. I pkt 1 Ustawy o Ofercie.
