Subject: Changes regarding the implementation of construction project ofCCGT power plant in Ostrołęka

With reference to the current report No. 25/2021 of 25 June 2021, theManagement Board of Energa SA (_quot;Issuer_quot;) informs that it has becomeaware of the signing on 3 October 2023 between CCGT Ostrołęka Sp. z o.o., on the one side, and GE Power Sp. z o. o. with its registered officein Warsaw and General Electric Global Services GmbH, based in Baden,Switzerland (collectively the _quot;General Contractor_quot;) on the other side ofthe annex (_quot;Annex_quot;) to the agreement of 25 June 2021 regarding theproject of the construction of a 745 MWe net gas-fired combined cyclegas turbine (CCGT) power plant in Ostrołęka (_quot;Project_quot;).

In accordance with the provisions of the Annex, the estimatedremuneration of the General Contractor for the implementation of theProject will increase from approximately PLN 2.5 billion net toapproximately PLN 2.85 billion net. The deadline for signing of theConditional Acceptance Certificate for the CCGT power plant in Ostrołękawas set for 31 December 2025.

The conclusion of the Annex results from the need to adapt the contractwith the General Contractor to the conditions that have arisen since theconclusion of this contract, in particular the outbreak of the war inUkraine and its impact on the raw materials, energy and constructionmarkets.
