Subject: Statement of claim for the repeal of the resolution of EnergaSA's Ordinary General Meeting

Legal basis: Art. 56 section 1 point 2 of the Act on Offerings - currentand periodic information

The Management Board of Energa SA (_quot;Company_quot;) informs that the Companyreceived from the Regional Court in Gdańsk, 9th Commercial Division, acopy of the statement of claim for the repeal of the resolution No. 5 ofthe Ordinary General Meeting of Energa SA on 20 June 2024 on thedistribution of the net profit for the financial year 2023 andallocation of this profit in full to the supplementary capital.

The Company does not agree with the statement of claim and will submit astatement of defence within the time limit set by the Regional Court inGdansk, which is handling the case.
