Notification regarding the method of taxation of the dividends due to the investment funds

As for the investment funds without legal personality set up by civil law partnership contract, in order to benefit from the dividend tax exemption provided by the art. 43 par. (1) and (2) from the Law 227/2015, the Participants/Custodians/Investment Management Companies/Investment Funds will submit to SIF Oltenia SA head office the following documents by 24.10.2017:

a) copy of the identity act of the legal representative of the management company of the investment fund (within the term of validity);

b) declaration under own responsibility in original drawn up by the legal representative of the management company from which explicitly results the type of the fund closed/open and the fact that the investment fund is not a legal entity during the year of the earning the income $(2017)$ :

c) copy of the confirmation of company details/other equivalent document for the fund's management company, no more than 3 months old, which mentions the legal representative of the fund's management company;

d) copy of the registration certificate/ other equivalent document for the fund's management company;

e) copies of the decisions of the regulation authority certifying the authorisation of the fund's management company and investment fund.

All the documents will be certified for compliance by the legal representative and will be submitted by post to the SIF Oltenia SA head office, 1 Tufanele Street, Craiova, Doli.

The investment funds without legal personality set up by civil law partnership contract which had the capacity of SIF Oltenia SA shareholders as of 12.09.2016, registration date for the dividends due for payment for the year 2015, will submit the same documents for reimbursement of the corresponding tax withhold, except that declaration at the point b) refers to the year 2016.
