Significant event to be reported / Eveniment important de raportat: Follow-up on the ad hoc announcement dated November 7th, 2013 with regards to the Eco Premium investigation by the Romanian Competition Council against OMV Petrom / Revenire raport curent din 7 noiembrie 2013 privind investigatia Eco Premium efectuata de Consiliul Concurentei impotriva OMV Petrom

As communicated through the ad hoc report dated November 7^th, 2013, OMV Petrom S.A. filed an appeal against the Bucharest Court of Appeal decision of rejecting OMV Petrom's S.A. request of annulling the Competition Council Decision no. 97/2011 regarding the result of the antitrust investigation concerning the withdrawal of the retail product Eco Premium (unleaded gasoline pre-mixed with lead substitute) from the Romanian fuels market.

On April 22, 2016, the High Court of Cassation and Justice allowed by majority of opinions the appeal of OMV Petrom S.A. and partially modified the challenged decision, in the sense that it partially allowed the court claim of OMV Petrom S.A. The High Court of Cassation and Justice partially annulled art. 2 point 1 of the Competition Council Decision no. 97/21.12.2011 issued by the Competition Council with respect to the amount of fine applied to OMV Petrom S.A., which is reduced to the amount of RON 297,806,409, representing 2.6% of the turnover in 2010. The decision is irrevocable.

The appeal filed by OMV Petrom Marketing S.R.L. (100% subsidiary of OMV Petrom S.A.) against the Bucharest Court of Appeal was also allowed by the irrevocable decision of the High Court of Cassation and Justice and the amount of the applied fine was reduced to the amount of RON 109,830,425 representing 2.4% of the 2010 turnover.

Asa cum a fost comunicat prin raportul curent publicat in data de 7 noiembrie 2013, OMV Petrom S.A. a formulat recurs impotriva hotararii Curtii de Apel Bucuresti prin care s-a respins cererea OMV Petrom S.A. de anulare a Deciziei nr. 97/2011 emise de Consiliul Concurentei cu privire la rezultatul investigatiei in materie de concurenta referitoare la retragerea de pe piata locala a sortimentului Eco Premium (benzina fara plumb aditivata cu substitut de plumb).

In data de 22 aprilie 2016, Inalta Curte de Casatie si Justitie a admis cu majoritate recursul OMV Petrom S.A. si a modificat in parte sentinta atacata, in sensul ca a admis in parte actiunea formulata de OMV Petrom S.A. Inalta Curte de Casatie si Justitie a anulat in parte art. 2 pct. 1 din Decizia nr. 97/21.12.2011 emisa de Consiliul Concurentei, in privinta cuantumului amenzii aplicate OMV Petrom S.A., care a fost redusa 297.806.409 pana la valoarea de RON. reprezentand 2,6% din cifra de afaceri din 2010. Decizia este irevocabila.

Recursul formulat de OMV Petrom Marketing S.R.L. (100% detinuta de OMV Petrom S.A.) impotriva hotararii Curtii de Apel Bucuresti a fost de asemenea admis prin hotarare irevocabila a Inaltei Curti de Casatie si Justitie si cuantumul amenzii aplicate a fost redus la suma de 109.830.425 RON reprezentand 2,4% din cifra de afaceri din 2010.
