Saipem: decisione di primo grado del Tribunale di Milano nel procedimento "Algeria"

San Donato Milanese (Milano), 19 settembre 2018 - Il Tribunale di Milano – Sezione IV Penale - ha pronunciato oggi la sentenza nel procedimento penale relativo a fatti di reato asseritamente commessi in Algeria fino al marzo 2010 in relazione ad alcune commesse completate da tempo.

Il Tribunale ha condannato, tra gli altri, anche alcuni ex manager della Società per i reati di corruzione internazionale ed ha, inoltre, condannato la Società al pagamento della sanzione pecuniaria di 400.000 euro, quale asserita responsabile dell'illecito amministrativo di cui agli artt. 5, 6, 7 e 25 commi 3 e 4 ai sensi del D. Lgs. 231/2001 con riferimento al reato di corruzione internazionale.

Gli ex manager della Società condannati dal Tribunale avevano tutti lasciato la Società tra il 2008 e il 2012.

Il Tribunale ha, altresì, disposto la confisca, quale asserito profitto del reato, della somma complessiva di circa 197 milioni di euro nei confronti di tutte le persone fisiche oggi condannate (e tra questi di alcuni ex manager della Società). Il Tribunale ha, altresì, disposto la confisca, quale asserito prezzo del reato, della somma complessiva di circa 197 milioni di euro nei confronti di Saipem ai sensi dell'articolo 19 del D. Lgs. 231/2001. Per quanto emerso nel corso del processo e dalle richieste del Pubblico Ministero, allo stato, risulta già in essere da tempo un sequestro preventivo finalizzato alla confisca per un importo pari a complessivi circa 160 milioni di euro nei confronti di alcune persone fisiche - diverse dalla Società – tutte condannate con la odierna sentenza. La decisione del Tribunale di primo grado non è esecutiva.

Saipem si riserva di impugnare la decisione del Tribunale alla luce delle motivazioni della decisione, che saranno depositate nel termine di 90 giorni.

Saipem: first instance ruling by the Court of Milan in the "Algeria" proceedings

San Donato Milanese (Milan), September 19, 2018 - The Court of Milan - Criminal Court Section IV - today pronounced judgement in the criminal proceedings concerning offences allegedly committed in Algeria up to March 2010 relating to certain contracts which were completed quite a few years ago.

The Court has convicted, amongst others, some former managers of Saipem for international corruption and has ordered the Company to pay the pecuniary sanction of 400,000 euro, as it is held liable for the administrative offence pursuant to Articles 5, 6, 7 and 25 paragraphs 3 and 4 of Legislative Decree 231/2001, with reference to the offence of international corruption.

The former managers of the Company convicted by the Court all left the Company between 2008 and 2012.

The Court also ordered, as alleged profit of the offence, the confiscation of the total sum of about 197 million euros for all the individuals sentenced today (and among them some former managers of the Company). The Court also ordered, as alleged price of the offence, the confiscation of the total sum of approximately 197 million euros in respect of Saipem pursuant to Article 19 of Legislative Decree No. 231/2001. As far as emerged during the trial and the requests of the Public Prosecutor, at present, a preventive seizure for a total amount of about 160 million euros has already been in place against some individuals - other than the Company - all condemned with today's ruling. The decision of the Court of First Instance is not enforceable.

Saipem reserves the right to appeal the Court's decision on the basis of the reasons underpinning the ruling, which will be filed within 90 days.
