Note on the Tar rulings on the 5G frequencies

Cagliari, November 29 2019

The Company declares itself satisfied with the outcome of the pronouncements of the Lazio Regional Administrative Court on the appeals filed by TIM, Iliad and Vodafone concerning the extension of the rights to use the 3.4-3.6 GHz frequencies enabling 5G, insofar as the pronouncements confirm the legitimacy of the temporal extension of the licences, as well as the transfer of the rights from Tiscali, through the subsidiary Aria S.p.A., to Fastweb.

On the other hand, the Company disagrees with the part of the pronouncements concerning the determination of the value of the rights of use, considering that it was determined on the basis of fair and reasonable criteria, which have not in any way negatively affected the competitive asset of the market.

Finally, it should be noted that these sentences, at the current state, have no impact on the Group's activities.
