Due to the final decision of Lithuanian Supreme Court

On 14 of March, 2011, Lithuanian Supreme Court has dismissed a cassation complaint of UAB Kauno termofikacinė elektrinė by its final decision and has left unchanged the decision of Vilnius Commercial Arbitration Court from 17 of February, 2010 and the decision of Lithuanian Court of Appeal from 19 of October, 2010 to award a forfeit in amount 5.419.808,82 Lt (five million four hundred nineteen thousand eight hundred eight Litas and 82 cents) from defendant UAB Kauno termofikacinė elektrinė in behalf of AB “Kauno energija” due to the fulfilment of the Investments agreement.
