Financial investor 3i, to which the Company transferred its gas engines and
diesel engines business for decentralised power generation (DEUTZ Power
Systems) in September 2007, announced to the Company that it will assert a
claim for reduction of the purchase price by way of arbitration action. The
action, if successful, would presumably have a significant impact on the
relevant annual results. 3i bases its claim on an alleged violation of
disclosure obligations in connection with the acquisition of DEUTZ Power
Systems. The Management Board has rejected the raised claims as being
without merit.
