Release according to § 26 para 1 sentence 1 WpHG

AXA Investment Managers Deutschland GmbH has notified us on August 11, 2009
in the name and on behalf of AXA S.A., Paris, France

as follows:

On August 7, 2009 the share of AXA S.A., Paris, France, of the voting
rights in BASF SE fell below the threshold of 3% of the voting rights in
BASF SE and at that date amounted to 2,88 % (26.416.321 voting rights).
These voting rights are attributed to AXA S.A. amounted to 2,88 %
(26.410.836 voting rights) pursuant to § 22 para 1 sentence 1 no 6 WpHG and
sentence 2 WpHG and amounted to 0,001 % (5.485 voting rights) pursuant to §
22 para 1 sentence 1 no 1 WpHG.
