Munich, July 7, 2010. As a result of a resolution by the Munich district
court, the ARQUES Industries AG business premises in Munich were searched
today by employees of the public prosecutor's office. The search is part of
a preliminary investigation against ARQUES Industries AG executive board
member, Michael Hütten, due to the suspicion of a breach of trust (§§ 266
I, II, 263 III No. 2 of the German Criminal Code) relating to the
withdrawal of a request for payment in the autumn of 2009 amounting to 19.6
million Euro owed to ARQUES Industries AG in his capacity as managing
director of Gigaset Communications GmbH at the time. The ARQUES Industries
AG executive board considers the allegation against Mr. Hütten not
supportable and is cooperating with the authorities in order to support
clearing up the matter rapidly.
