MSP Holding obtains in Court Expansion of Agenda for General Assembly of
freenet AG

Maintal, 27 June 2008. The local Court of Kiel has granted the motion of
MSP Holding to expand by several items the agenda of the general meeting of
freenet AG to be held on 8 August in Hamburg. MSP, a joint venture of
United Internet AG and Drillisch AG, is the largest shareholder of freenet
with a stake of 24.51 %.

The management of freenet had refused to expand the agenda according to
MSP’s suggestions. Therefore, MSP had to enforce its request in Court. By
an order of 25 June 2008 the Registry Court of Kiel has fully granted MSP’s
motions. All items which MSP has requested for the agenda will form part of
the freenet AGM on 8 August 2008.

They include, among others:

• A motion for a vote of non-confidence in the acting management board of
  freenet AG

• Termination of the members of the supervisory board elected by the
  shareholders and election of the new members

• Mandates for special audits in connection with the debitel-transaction
  and the belated convention of the freenet AGM

The management board had rejected MSP’s request to the company with the
contention that MSP’s shareholders’ rights were suspended because of an
allegedly incorrect voting right notification, even though both the higher
Court of Kiel and the Federal Financial Services Supervisory Authority
(Bundesanstalt für Finanzdienstleistungsaufsicht – BaFin) had determined
concurrently that there had been no incorrect notification.

Paschalis Choulidis, managing director of MSP and chairman of Drillisch AG,
said: 'Being the largest freenet shareholder, we are happy that we now can
present our justified requests to the forthcoming general meeting. Over the
past year, management and supervisory board have not been interested in the
interests of their shareholders, now shareholders can you their
disagreement by creating facts.'
