Body of the report:

The Management Board of ENEA S.A. ("Issuer") hereby reports that on 7July 2022 it signed a surety agreement with Izba Rozliczeniowa GiełdTowarowych S.A. ("IRGiT") for the liabilities of its subsidiary, ENEAElektrownia Połaniec S.A. ("Subsidiary") up to the amount of PLN4,000,000,000 ("Agreement"). The surety covers all liabilities incurredby the Subsidiary for the clearing of transactions by IRGiT.

The surety will remain in force until 30 April 2023.

In connection with the execution of the Agreement, the Issuer hasprovided a notarized declaration of its voluntary submission toenforcement pursuant to Article 777(1)(5) of the Code of Civil Procedureup to the amount of the granted surety, that is up to PLN 4,000,000,000.IRGiT will be entitled to initiate legal action to issue an enforcementclause on the said notarized declaration until 30 September 2023.

The other terms of the Agreement do not differ from the provisionstypical of this type of contract.
